What and who is covered and for how long:
Rose Fence, Inc., applies this warranty to its vinyl fences, railings, decks and specialty products with terms and limitations stated herein, to be free from defective materials, and when subject to proper use, is warranted against surface peeling, rot, ground insects, splitting, corrosion, flaking, rusting and blistering, abnormal weathering or discoloration under conditions of normal use and service. Rose Fence, Inc., warrants only those profiles manufactured by Rose Fence, Inc., and any use of non-Rose products will void the warranty. The warranty applies only to the original purchaser.
The lifetime warranty coverage is designed to cover homeowners exclusively. If the Rose Fence, Inc., products are purchased for use in commercial, industrial, governmental or institutional projects, for example (schools, churches, factories, condominium complexes, marinas etc...), the applied warranty will be thirty(30) years following the installation of the vinyl product. In addition, the thirty(30) year warranty is non-transferrable.
Exclusions:
Rose Fence, Inc., shall not be liable for and this warranty does not apply to any failure, defect or damage resulting from or connected with the following:
A. defects not caused by Rose(for example, but not limited to: accidents, misuse, improper applications or installations contrary to Rose Fence or industry standards.)
B. product that has been painted or has had its surface treated with any chemicals not approved by Rose Fence, Inc.
C. product subject to impact of foreign objects, tornado, hurricane, fire, air pollutants, normal weathering of surfaces, abnormal coloring due to improper maintenance, discontinuation of products including colors and acts of God.
D. hardware, gate or accessory items; installation of these products or defects caused by their installation.
E. Rose Fence, Inc’s. Lifetime Warranty will not be applicable for products that are covered under a separate warranty.
Warning:
Rose Fence, Inc., and its employees are not qualified to approve, recommend or advise as the suitability of this product for all possible end applications. Your local authority or fire marshal’s office should be consulted as to its safety for your intended uses. Like other building materials, Rose Fence, Inc., vinyl products cannot be expected to contain a horse or other large animal that chooses to break free from the fence containing it, and therefore makes no representation about and does not warrant against such an occurrence.
Registration of Warranty:
The attached registration warranty card must be completed, signed by the original purchaser and the installing contractor and returned to Rose Fence, Inc., within thirty(30) days after completion of installation of products in order for purchaser to be eligible for coverage under this warranty.
Claims and Remedies:
A claim under this warranty must be reported in writing with proof of purchase, to Rose Fence, Inc., 345 West Sunrise Hwy., Freeport, N.Y. 11520, within thirty (30) days of the date that the defect was first discovered or reasonably could be discovered. A reasonable time should be allowed for Rose Fence, Inc., to inspect the material, or at Rose’s option, freight to our premises to be prepaid by the purchaser for examination of the alleged defective product. Rose shall be the sole judge of whether or not the material is defective and whether the defect is due to manufacturing defects. If, after its inspection, Rose Fence determines the claim is in accordance with its warranty, then Rose Fence agrees to replace the portion of the fence or part of the product that is in question. This warranty does not cover the cost of installation of any defective parts or the labor to replace any replacement product furnished under terms of this warranty. The foregoing warranty excludes all other warranties , express or implied, including any warranty of fitness for a particular purpose, or of merchantability. No incidental or consequential damages will be paid. By acceptance and use of this product, purchaser agrees, that Rose Fence, Inc. liability and the purchaser’s exclusive remedy for breach of any warranty shall be limited in all events to replacement of any section or part of this product which shall be returned to Rose Fence, Inc. and which is found to be defective. |
